Skilly Up is committed to providing quality services and respecting your rights. Your right to privacy and confidentiality will be recognised, respected and protected in every part of your contact with us. This statement sets out how we manage your personal information. Skilly Up complies with the Privacy Act 1988 (Cth).
What is personal information and why do we collect it?
Personal information is information or an opinion that identifies an individual. It includes health information, which is information about the physical or mental health or disability of a person. Examples of what we collect include names, addresses, email addresses and phone numbers.
We collect it in a number of ways, including interviews, correspondence, by telephone, by email and through our website. We only request and keep personal information that is necessary to:
- assess your eligibility for support
- provide safe and responsive support
- monitor the supports provided
- meet contractual and other requirements to provide non-identifying data and statistical information to government agencies
When we collect personal information, we explain why we are collecting it and how we plan to use it.
Third parties
Where it is reasonable and practicable, we collect your personal information only from you. In some cases we may be given information by a third party, such as another disability service. If that happens, we take reasonable steps to make sure you know what was provided to us.
AI use and disclosure
How we use AI tools
Skilly Up may use AI tools to help deliver our services. This can include research and idea generation, drafting and writing, editing and proofreading, design and layout, transcription and note taking, data analysis and reporting, scheduling and administration, and customer communications. By working with us you acknowledge and consent to the use of AI tools as part of the services.
A person always reviews and checks work created or supported by AI tools for accuracy and suitability before it is delivered. Skilly Up remains fully responsible for the quality of the final work, whether or not AI tools were involved.
AI assisted output can have limitations. Skilly Up is not liable for errors or omissions that are reasonably attributable to the functioning of an AI tool, provided we have met our review obligation. Clients are responsible for reviewing deliverables and telling us about any error or concern before relying on, publishing or distributing them.
Restrictions on using our IP in AI tools
Without our prior written consent, a client must not use any part of the deliverables or Skilly Up's intellectual property to:
- reverse engineer, deconstruct, replicate or adapt them, including through the use of AI tools
- input into, train, develop, improve or enhance any AI tool, model or algorithm
Clients must take reasonable steps to make sure their personnel, contractors and any third party given access to the deliverables also comply. A licence to use the deliverables does not permit these uses, and this obligation survives the end of the contract.
Neither party may enter the other party's confidential information into an AI tool unless the other party has given prior written consent, or the tool is operated privately and the information is not retained by, or used to train or improve, any third party model.
Deliverables, ownership and liability
Some deliverables may be created with the assistance of AI tools. Where intellectual property rights exist in the deliverables and are owned by Skilly Up, those rights are assigned or licensed to the client as set out in the contract. Rights may not exist in material generated solely by an AI tool without sufficient human authorship. Where rights do not exist or cannot be assigned, we grant a perpetual, worldwide, royalty free licence to use that material for the purpose described in the contract.
Intellectual property created through the use of AI tools in our own tools, frameworks or methods stays with Skilly Up unless the contract says otherwise. Clients warrant that any material they supply for use with an AI tool does not infringe the rights of a third party, and indemnify us against claims arising from that material.
To the extent permitted by law, Skilly Up is not liable for loss arising from a client's use or misinterpretation of AI assisted output after it has been delivered. Nothing here limits rights under the Australian Consumer Law that cannot be excluded.
AI and your personal information
We use AI tools to help run our business and deliver our services. In doing so your personal information may be processed by these tools, for example to help draft communications, analyse information, transcribe, schedule or provide support. We take reasonable steps to handle your information securely and in line with this policy and the Australian Privacy Principles. We do not sell your personal information.
Some of the AI tools and providers we use are located, or store data, outside Australia, for example in the United States and the European Union. Where that happens, your information may be disclosed to or accessed from overseas. We take reasonable steps to make sure those providers handle it consistently with the Australian Privacy Principles.
Where we use a computer program to make, or substantially help make, a decision using your personal information that could reasonably be expected to significantly affect your rights or interests, we will tell you. That includes the kinds of information used and the kinds of decisions involved.
You can ask us how your personal information is handled, including in relation to AI tools, or ask us to access or correct it, by emailing hello@skillyup.com.au. If you have a concern, contact us first. You can also contact the Office of the Australian Information Commissioner at oaic.gov.au.
Disclosure of personal information
Your personal information will only be disclosed:
- to prevent or lessen a serious and imminent threat to the life or health of you or another person
- to outside agencies with your or your representative's permission
- with written consent from a person with lawful authority
- when required by law, or to meet legislative obligations such as mandatory reporting
Security and destruction of personal information
Your personal and health information is stored in a way that reasonably protects it from misuse, loss, and unauthorised access, modification or disclosure.
When it is no longer needed for the purpose it was obtained for, we take reasonable steps to destroy it or permanently de-identify it. We retain and dispose of information in line with our Privacy and Confidentiality Policy and Procedure.
Access to your personal information
You can access the personal or health information we hold about you, including to update or correct it, subject to some exceptions. If you would like access, please speak to a staff member. To protect your information we may ask for identification before releasing it.
You have the right to:
- request access to personal information we hold about you
- access this information
- make corrections if you consider the information is not accurate, complete or up to date
Access may be denied in part or in full where:
- the request is frivolous or vexatious
- providing access would have an unreasonable impact on the privacy of other people
- providing access would be likely to prejudice an investigation of possible unlawful activity
- providing access would pose a serious and imminent threat to the life or health of any person
- denying access is required or authorised by or under law
We aim to address all requests to access or correct information within two working days. There is no fee for an access request, though we may charge an administrative fee for providing a copy.
Maintaining the quality of your personal information
It matters to us that your information is up to date. We take all reasonable steps to make sure it is accurate and complete. If anything we hold is out of date or incorrect, please let us know as soon as you can so we can update our records.

Monitoring and review
This privacy statement, along with our Privacy and Confidentiality and Records and Information Management policies and procedures, is formally reviewed at least once a year. Reviews include feedback from participants, staff and other stakeholders.
